1 About these Terms and TeleHeadache
These Terms govern your use of TeleHeadache’s website, patient platform, membership, and related administrative services. TeleHeadache LLC ("TeleHeadache," "we," or "our") operates these services and provides clinical care through appropriately authorized clinicians. Your enrollment summary and receipts identify the entity responsible for your membership charges.
Please read these Terms before creating an account or purchasing services. When you affirmatively accept these Terms during enrollment, you agree to them. Browsing educational material alone does not enroll you in a membership, authorize a charge, or establish a clinician-patient relationship.
These Terms work together with our Membership Cancellation and Refund Policy, Telehealth Informed Consent, and Pharmacy and Delivery Policy. The membership policy controls a conflict about cancellation or refunds; your telehealth consent controls a conflict about consent to care. Our Privacy Policy and Notice of Privacy Practices explain information practices and applicable privacy rights. Accepting these Terms does not waive those rights or authorize a use of health information that requires separate permission.
Back to top ↑2 Emergencies and limits of online care
TeleHeadache does not provide emergency care. Call 911 or seek emergency care immediately if you believe you are experiencing a medical emergency. Do not wait for an assessment, message, or video appointment.
Our assessments and messages are not continuously monitored. Website access at any hour does not mean a clinician is available at every hour. Public education, symptom descriptions, and software-generated summaries are not an individual diagnosis or treatment plan. Follow your clinician’s instructions and obtain an in-person examination or emergency evaluation when needed.

Clinical enrollment is for adults age 18 or older who can provide legally valid consent and meet the service’s clinical and operational eligibility requirements. Florida is our current service area. Availability depends on where you are physically located when care is provided and whether the treating clinician is authorized to practice there. A mailing address alone does not establish eligibility.
Provide accurate identity and location information and tell us before receiving care while traveling. We may verify your identity and location and may defer or decline care when authorization or eligibility cannot be established. Do not misstate your location or use technical measures to bypass geographic restrictions. A preliminary eligibility screen does not guarantee that your condition can be managed through this service.
Use your own account. A caregiver may assist with your permission, but may not impersonate you, substitute their answers for yours, or access your records without appropriate authorization. Contact support if you need an accommodation or help establishing an authorized representative.
Insurance coverage may affect enrollment even though membership is cash-pay. The standard cash-pay membership is not available to patients with Original Medicare, Medicare Advantage, Medicare with Medicaid, or TRICARE For Life unless TeleHeadache confirms an approved separate pathway for their coverage and assigned clinician. A separate pathway is not guaranteed. Patients with Medicaid or other TRICARE coverage must contact us before enrolling for review.
VA healthcare, CHAMPVA, FEHB, or PSHB coverage alone does not exclude an otherwise eligible patient; other coverage rules still apply. TeleHeadache does not accept or process VA Community Care referrals or authorizations. Tell us about all coverage you have and review our insurance eligibility guidance before enrollment.
4 Clinical services and professional judgment
Standard care uses a structured assessment followed by asynchronous clinician review. A clinician independently evaluates your information and decides whether more history, secure messages, video, testing, in-person care, or another referral is needed. Technology may organize information and support clinical review; it does not replace the clinician’s judgment or independently issue prescriptions.
Purchasing membership does not itself establish a clinician-patient relationship. That relationship is established through the clinician’s acceptance and provision of care under applicable law. Where the law imposes duties earlier, these Terms do not delay or eliminate them.
A licensed clinician reviews your completed assessment within 24 hours. The 24-hour period starts when your completed initial assessment is successfully submitted. Missing information, safety concerns, verification needs, or unusual interruptions can affect timing. This is not a promise of a completed diagnosis, prescription, pharmacy approval, or delivery within 24 hours. Message-response and appointment availability are separate from the initial-assessment review timeframe.
Membership includes the initial assessment, appropriate clinician review, and access to ongoing headache-care services such as refill review, tracking, limited secure messaging, and clinically appropriate treatment adjustments. It does not include unlimited messages, unlimited treatment changes, emergency services, or continuous live medical access. Your clinician may require reassessment before further treatment.
No diagnosis, prescription, particular medication, treatment outcome, or insurer approval is guaranteed. Prescriptions depend on clinical judgment and applicable law. Controlled substances are outside TeleHeadache’s treatment model. A clinician may recommend care that TeleHeadache cannot provide; outside services are separately arranged and billed.
Back to top ↑5 Membership prices and separate costs
All three plans include the same standard clinical services. Their billing periods and total charges differ:

The three-month and six-month amounts are charged in full; they are not monthly installment plans. Membership activates when enrollment and payment succeed, before you complete the full clinical assessment. There is no separate initial-assessment fee. Your checkout shows the amount due, billing period, activation date, next renewal date, and any applicable tax before you authorize payment.
Optional patient-selected video visits cost $200 per visit. Video visits that a clinician determines are required cost $75 per required visit. Video fees are separate from membership. You receive the applicable fee and must authorize the charge before the visit is booked. A video recommendation does not authorize a charge automatically.
Medication, pharmacy charges, copays, deductibles, shipping, tests, imaging, and outside care are not included. Membership is not health insurance and does not pay for those expenses. Uninsured patients may enroll if otherwise eligible. Membership charges are cash-pay and are not submitted by TeleHeadache to your health plan. Pharmacy use of prescription benefits is a separate transaction. We do not guarantee insurance reimbursement or eligibility for HSA or FSA payment.
Back to top ↑7 Cancellation refunds and price changes
Cancel future renewal in the patient portal under Membership → Manage membership → Cancel renewal, or contact admin@teleheadache.com. You do not have to speak with a retention representative or provide a reason. A support cancellation takes effect when we receive your identifiable request, even if staff process it later.
Ordinary cancellation leaves access available through the paid-through date. Refunds are governed by the membership policy. It includes a full first-period refund before initial clinician review starts; a full refund when initial evaluation establishes that our service is unsuitable and no TeleHeadache treatment plan is provided; a safeguard for an unsubmitted assessment; and specified renewal and service-interruption protections. Once review begins, other cancellation requests follow that policy. A prescription denial alone does not establish refund eligibility.
We give at least 30 days’ notice before a proposed membership price increase. We obtain your affirmative agreement before charging an increased recurring price; if you do not agree, renewal stops at the end of the current paid period. We do not increase a price retroactively. Plan changes take effect at the next renewal unless you separately accept a clearly disclosed alternative.

Give complete, accurate information about symptoms, medications, allergies, medical conditions, pregnancy-related information when relevant, and other treating clinicians. Correct mistakes promptly. Follow assessment and follow-up instructions, review your treatment plan, and tell the clinical team about important changes, adverse effects, or ineffective treatment. Do not wait for an online response when urgent care is needed.
Protect your sign-in credentials, use available security measures, and report suspected unauthorized access promptly. You are not automatically responsible for unauthorized activity caused by our failure or by circumstances beyond your reasonable control. We may temporarily restrict access to investigate a security concern while providing an appropriate alternative support channel.
Do not harass personnel, submit knowingly false records, interfere with security, introduce malware, scrape protected information, access another person’s account, or use the service unlawfully. Good-faith criticism, complaints, safety reports, and honest reviews are permitted.

Use the secure portal for clinical questions and sensitive health information. Ordinary email, public website forms, and social media are not the appropriate channels for detailed medical information. Administrative support cannot diagnose conditions or authorize treatment.
We may send necessary account, billing, appointment, and service notices using your selected or required communication channels. Where a separate consent is required for texts or other communications, we obtain it. Marketing permission is optional and separate from treatment and billing consent. Opting out of marketing does not cancel membership. Contact support to update your contact details or communication preferences.

During enrollment, we ask separately for your agreement to electronic delivery of account agreements, billing notices, receipts, service notices, and related consent records. You may review, save, and print the documents before agreeing. Electronic consent is not inferred merely from opening this page.
You need internet access, an active email address, a device with a supported web browser, and the ability to open, save, or print HTML pages and PDF documents. You may request a paper copy of these account agreements and billing notices without charge through support. Medical-record copy requests follow the Notice of Privacy Practices and applicable law.
You may withdraw consent to electronic delivery or update your electronic contact information by contacting support. Withdrawal does not invalidate earlier electronic records. We will explain available alternatives and any effect on continued use of this online service. We do not impose a withdrawal fee; cancellation and any resulting refund follow the membership policy. If a material technical change affects your ability to access records, we provide updated requirements and seek renewed consent when required.

Your health information is handled under the applicable privacy notices and law. These Terms do not give us an unrestricted ownership interest in your medical information, a license to sell it, or permission to use identifiable patient material in advertising. You authorize us to process information you submit only as needed to provide the service and for other purposes permitted by the applicable notices and law.
We or our licensors own the website’s original design, trademarks, software, and educational content. You may use the service for its intended purpose and save or print your own records and reasonable portions of public information for personal use. Do not commercially republish protected content or misrepresent affiliation with TeleHeadache. These restrictions do not limit rights the law gives you or another person.
Back to top ↑12 Pharmacies outside services and technical interruptions
Pharmacies, insurers, laboratories, other clinicians, and delivery services perform their own functions and may have their own policies. A link or coordination arrangement does not guarantee their performance. We remain responsible for our own conduct, including any responsibility the law assigns to us for arrangements we make.
Online services can be interrupted by maintenance, connectivity problems, or security events. We take reasonable steps to restore access and communicate material interruptions. If care cannot be provided, contact support for available alternatives and the refund protections in the membership policy. Do not use a website outage as a reason to delay urgent evaluation.
Back to top ↑13 Ending or restricting services
We may restrict or end services for a material breach of these Terms, credible safety or security concerns, loss of legal authority to treat you, or a clinical determination that another care setting is needed. When feasible, we give notice and an opportunity to correct an administrative problem. Immediate restrictions may be necessary to protect safety or security.
Ending a membership does not erase professional duties, required notice, record-access rights, or appropriate care-transition responsibilities. We stop future renewal and apply the membership policy’s refund rules. You may also request that active care end before your paid-through date; doing so does not by itself create an additional refund beyond that policy or applicable law.
Back to top ↑14 Rights concerns and disputes
Please contact support about an account or billing problem. Clinical concerns will be directed to the clinical entity. You may also contact an appropriate licensing board, regulator, insurer, card issuer, or court without first using our internal process.
These Terms do not require arbitration, waive class proceedings, shorten a statutory claim period, or limit liability for medical negligence, personal injury, fraud, willful misconduct, or violation of rights that cannot lawfully be waived. They do not require you to indemnify us for the provision of healthcare. No description of clinical uncertainty excuses a failure to meet the applicable standard of care.
Florida law governs to the extent applicable, together with controlling federal law. Mandatory protections provided by another applicable jurisdiction remain available. A dispute may be brought in a court with proper jurisdiction and venue; these Terms do not require an otherwise impermissible or unreasonably burdensome exclusive forum.

We may update these Terms prospectively. Material changes affecting an existing membership will be communicated at least 30 days before they apply, except a shorter period may be needed to comply with law or address an urgent security issue. We seek new affirmative acceptance when required and do not apply changes retroactively to a dispute that has already arisen. A material reduction of paid services will be handled with notice and an appropriate cancellation or refund option.
If a provision is unenforceable, the remaining lawful provisions remain effective. Our failure to enforce a provision immediately does not waive later enforcement. A transfer of business does not eliminate existing patient, privacy, or refund obligations; required notices and consents still apply.
